EvoHost provides premium hosting solutions including but not limited to:

• Virtual Private Servers (VPS)
• Dedicated Servers
• Web Hosting Services
• Discord Bot Hosting
• DDoS Protection Services

We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, including hours of operation or availability of the Service or any Service feature, without notice and without liability.

3. Account Terms

3.1 Account Creation

To use certain features of the Service, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. We encourage you to use "strong" passwords with your account.

3.3 Account Termination

We reserve the right to suspend or terminate your account and refuse any and all current or future use of the Service, or any other EvoHost service, for any reason at any time.

4. Payment and Billing

4.1 Service Fees

You agree to pay all fees or charges to your account in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable.

4.2 Billing Cycle

Services are billed on a monthly basis unless otherwise specified. Your payment will be charged to your chosen payment method on the calendar day corresponding to the commencement of your paid subscription.

4.3 Refund Policy

We offer a 7-day money-back guarantee on our hosting services. Refund requests must be submitted within 7 days of initial purchase. Certain services may be excluded from the refund policy as specified during purchase.

5. Prohibited Activities

You agree not to use the Service to:

• Host, distribute, or link to any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Distribute malware, viruses, or any other destructive code
• Violate any laws or regulations (including but not limited to copyright laws)
• Run any type of cryptocurrency mining software
• Participate in any form of network attack or unauthorized access to other networks/systems
• Send spam or unsolicited commercial communications
• Host pornography, gambling, or other adult-oriented content

Violation of these terms may result in immediate account suspension or termination without refund.

6. Service Level Agreement (SLA)

6.1 Uptime Guarantee

We guarantee 99.9% network uptime for all our hosting services. If we fail to meet this guarantee, you may be eligible for service credits as outlined in our SLA.

6.2 Support

We provide technical support through our ticketing system and Discord server. Support response times vary based on service type and severity level.

6.3 Maintenance

We reserve the right to perform maintenance on our infrastructure. We will provide advance notice for scheduled maintenance whenever possible.

7. Limitation of Liability

In no event shall EvoHost, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use or alteration of your transmissions or content

8. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you must stop using the Service.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of our jurisdiction, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
